2. Information We Collect

2.1 Information You Provide Directly

When you create an account or use the Service, we may collect:

  • Name and email address
  • Authentication credentials associated with your account (we do not store plaintext passwords or passcodes)
  • Health and dietary preferences you choose to set in the App (e.g., allergen alerts, dietary goals). This information may constitute sensitive personal information under applicable law (see Section 11) and is used solely to provide and improve the Service.
  • Products you scan, search, or manually enter into the App
  • Community reports or feedback you voluntarily submit about products
  • Communications you send to us, such as support requests

2.2 Information Collected Automatically

When you use the Service, we automatically collect:

  • Device type, model, operating system version, and unique device identifiers
  • IP address
  • App version and session data (screens visited, features used, session duration)
  • Crash reports and diagnostic data
  • General usage patterns and interaction logs

2.3 Camera and Barcode Scanning

The App requests access to your device camera to scan product barcodes and, where you choose to use it, to photograph product labels or packaging for ingredient analysis. Barcode scans are processed locally to read the product identifier; no barcode image is retained. Where product label images are captured for analysis, those images are transmitted to our servers for processing and are not retained beyond the time needed to generate your product score. We do not use camera access for any other purpose. You may deny camera access at any time in your device Settings. Denying camera access limits barcode scanning and label-photo features but does not affect other App features.

2.4 Algorithmic Processing and AI Disclosure

When you scan or search for a product, the product identifier is processed through our Proprietary Scoring Systems to generate a safety and nutritional score. This processing occurs on our servers. If you are logged into your account, your scan history and associated scores may be stored and linked to your account to enable scan history, personalized recommendations, and dietary preference alerts.

As of the effective date of this Privacy Policy, our Proprietary Scoring Systems do not share your Personal Data with third-party artificial intelligence providers. If this practice changes, we will update this Privacy Policy and obtain your explicit consent before doing so, as required by applicable law and Apple App Store Review Guidelines (Guideline 5.1.2(i)).

2.5 Information We Do Not Collect

We do not collect:

  • Biometric data (facial recognition, fingerprints, voiceprints)
  • Financial account or payment card information (all payments are processed through Apple's in-app purchase infrastructure)
  • Protected health information (PHI) as defined under HIPAA
  • Personal information from children under 13 without verified parental consent (see Section 10)

3. How We Use Your Information

We use the information we collect for the following purposes:

  • **To provide the Service:** Delivering product safety scores, nutritional analysis, and personalized recommendations based on your preferences and scan history.
  • **To manage your Account:** Creating, maintaining, and authenticating your user account and subscription status.
  • **To process payments:** Verifying subscription and purchase status through Apple's in-app purchase system. We do not process or store payment card information.
  • **To improve the Service:** Analyzing aggregated, anonymized usage patterns to identify issues, improve features, and enhance user experience.
  • **To communicate with you:** Sending account notifications, security alerts, and - with your explicit consent - marketing communications. You may opt out at any time.
  • **To enforce our policies:** Detecting and preventing fraud, abuse, or violations of our Terms and Conditions.
  • **For legal compliance:** Meeting our obligations under applicable federal and state law.
  • **For business transfers:** In connection with a merger, acquisition, or sale of assets, as described in Section 4.

We will not use your Personal Data for purposes materially different from those listed above without first updating this Privacy Policy and, where required by law, obtaining your consent.

4. Sharing Your Information

We do not sell your Personal Data. We do not rent or trade your Personal Data to third parties for their own marketing purposes. We may share your information only in the following circumstances:

  • **Service Providers:** We share data with trusted third-party vendors who perform services on our behalf (e.g., cloud hosting, analytics, email delivery). By contract, these providers are required to handle your data only as directed by us, to maintain security standards equal to or greater than those described in this Privacy Policy, and in compliance with Apple App Store guidelines. They may not use your data for any independent purpose.
  • **Apple App Store / In-App Purchases:** Subscription and purchase transactions are processed by Apple. Apple's Privacy Policy governs their data practices.
  • **Legal Requirements:** We may disclose your information if required by law, court order, or governmental authority, or when we have a good-faith belief that disclosure is necessary to protect the rights, property, or safety of the Company, our users, or the public.
  • **Business Transfers:** In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred to the acquiring entity. We will provide notice before your Personal Data is transferred and becomes subject to a different privacy policy.
  • **Third-Party AI Disclosure:** If we integrate third-party artificial intelligence services that process your Personal Data, we will clearly disclose this in an updated Privacy Policy and obtain your explicit consent prior to any such data sharing, consistent with Apple App Store Review Guidelines (Guideline 5.1.2(i)).
  • **With Your Consent:** We may share your information for any other purpose with your explicit prior consent.

5. Data Retention and Deletion

5.1 Retention Policy

We retain your Personal Data only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law:

  • Account information is retained for as long as your account is active, and for up to ninety (90) days thereafter for account reactivation support, dispute resolution, and legal compliance.
  • Scan history and preferences are retained as long as your account exists and are deleted when you delete your account.
  • Usage data and diagnostic logs are typically anonymized or deleted within 12 months.
  • Payment and transaction records may be retained for longer periods as required by financial reporting and tax law.

5.2 Account Deletion - In-App

If you wish to delete your account and associated Personal Data, you may initiate account deletion directly from within the App: navigate to Settings > Account > Delete Account. You may also contact us at privacy@checkwithmana.com

Upon receiving a verified deletion request, we will delete or anonymize your personal information within thirty (30) days, except where retention is required for legal compliance, unresolved disputes, or enforcement of our agreements. We will inform you if any data must be retained, the reason, and the anticipated duration.

5.3 Revoking Consent

Where we rely on your consent as the legal basis for processing your Personal Data (e.g., marketing communications, optional features), you may withdraw that consent at any time by:

  • Adjusting notification and communication preferences within the App (Settings > Notifications / Communication Preferences)
  • Using the unsubscribe link in any marketing email we send
  • Contacting us at privacy@checkwithmana.com

Withdrawing consent will not affect the lawfulness of processing that occurred before the withdrawal. Certain features that depend on that consent may become unavailable.

6. Security of Your Information

We implement commercially reasonable technical and organizational measures to protect your Personal Data, including encryption of data in transit (TLS/HTTPS), secure credential storage (hashed passwords), and access controls limiting internal access to personal information.

No method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your information. In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify you and, where required by applicable law, the relevant supervisory authority. Where required under the GDPR, we will notify the applicable supervisory authority within 72 hours of becoming aware of a qualifying breach. We will notify affected users without undue delay using the contact information associated with your account, and will include information about the nature of the breach, the likely consequences, and the measures we have taken or propose to take to address it.

7. Third-Party Services

7.1 Analytics Providers

We may use third-party analytics services to understand how the App is used. Each such provider is contractually required to protect your data consistently with this Privacy Policy and Apple App Store guidelines.

7.2 Payment Processing

All in-app purchases and subscription billing are handled through Apple's App Store in-app purchase system. We do not receive, process, or store your payment card information. Apple's Privacy Policy (apple.com/legal/privacy) governs all payment-related data.

7.3 Third-Party Links

The App may contain links to third-party websites or services. We have no control over and assume no responsibility for the privacy practices of any third-party sites. We encourage you to review the privacy policy of every external site you visit.

8.3 Opt-Out of Marketing

You may opt out of marketing communications at any time using the mechanisms described in Section 5.3.

8.4 Device Permissions

You may revoke permissions such as camera access at any time through your iOS device Settings. Revoking camera access disables barcode scanning but does not affect your account or other App features.

9. GDPR Privacy (European Union and EEA Users)

9.1 Legal Basis for Processing

If you are located in the European Economic Area (EEA), we process your personal data under the following legal bases: Mana World LLC is the data controller responsible for your personal data as described in this Privacy Policy. As data controller, we determine the purposes and means of processing your personal data and are responsible for ensuring that processing complies with applicable data protection law, including the General Data Protection Regulation (GDPR).

  • **Contract Performance:** Where processing is necessary to provide the Service you have requested.
  • **Legal Obligations:** Where processing is required by applicable law.
  • **Legitimate Interests:** Where processing is necessary for our legitimate interests (e.g., security, fraud prevention, App improvement), provided those interests are not overridden by your rights.

9.2 Your Rights Under GDPR

If you are in the EEA, you have the right to: access your data, rectify inaccurate data, erasure under certain circumstances, restriction of processing, data portability, object to processing, withdraw consent at any time without affecting prior lawful processing, and lodge a complaint with your local Data Protection Authority. You also have rights in relation to automated decision-making: where the App generates product scores that may influence your purchasing or dietary decisions, you may contact us to request information about the logic involved in that scoring and to express your views. We do not make decisions with legal or similarly significant effects based solely on automated processing without human review.

To exercise any of these rights, contact us at privacy@checkwithmana.com. We may ask you to verify your identity before responding.

10. Children's Privacy

The App is not directed to individuals under the age of 13. We do not knowingly collect Personal Data from children under 13. Users between the ages of 13 and 17 may use the Service only with the review and agreement of a parent or legal guardian, as set forth in our Terms and Conditions. If you are a parent or guardian and believe your child has provided us with personal information without your consent, contact us immediately at privacy@checkwithmana.com. We will delete that information as promptly as possible.

If we learn we have collected personal information from a child under 13 without verified parental consent, we will delete that information immediately.
